Terms of Use

The short version

This box is a plain-English summary. It is not the agreement — the numbered sections below are — but nothing here contradicts them.

  • Peak is free to download. Elite is an optional auto-renewing subscription billed by Apple: $9.99/month or $59.99/year.
  • It renews automatically until you cancel. Cancel any time in iPhone Settings → your name → Subscriptions. Refunds are handled by Apple, not by us.
  • Your goals, tasks and journal entries are yours. We don't sell them and we don't claim ownership.
  • Peak is a discipline tool. It is not medical, mental-health, legal or financial advice, and the AI coach can be wrong.
  • You must be at least 13. Don't abuse other users, don't try to break the app, and don't use it to hurt anyone.
  • You can delete your account and data at any time, from inside the app.

1. Accepting these terms

These Terms of Use (the "Terms") are a binding agreement between you and Brian Goodman, sole proprietor, trading as Peak ("Peak," "we," "us," "our"), governing your use of the Peak mobile application, the peakapp.org website, and any related services (together, the "Service").

By downloading, installing, creating an account in, or otherwise using the Service, you confirm that you have read and agree to these Terms and to our Privacy Policy and AI Policy, both of which are incorporated here by reference. If you do not agree, do not use the Service.

2. Who we are

Peak is operated by Brian Goodman, an independent developer based in the State of Nevada, United States. You can reach a human at support@peakapp.org. There is no phone line; email is the only official support channel.

3. Age & eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live, you may use Peak only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

If you are in the European Economic Area, the United Kingdom, or another region with a higher digital-consent age, you must meet that local minimum age (up to 16 in some countries) or have verifiable parental consent.

You may not use the Service if you are barred from doing so under the laws of the United States or your country of residence, or if we have previously terminated your account for a breach of these Terms.

4. Your account

Some features require an account. You agree to provide accurate information, to keep your credentials secure, and to tell us promptly at support@peakapp.org if you believe your account has been accessed without your permission.

You are responsible for activity that occurs under your account. Do not share your account, and do not create an account on behalf of someone else without their permission.

5. Licence to use Peak

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the Peak app on Apple-branded devices you own or control, for your own personal, non-commercial self-improvement.

This licence does not permit you to: sell, rent, sublicense, or redistribute the app; copy or modify it except as permitted by applicable law; reverse-engineer, decompile or disassemble it except to the extent that restriction is prohibited by law; remove any proprietary notices; or use it to build a competing product.

6. Subscriptions & billing

Peak is free to download and the core functionality remains usable without payment. Peak Elite ("Elite") is an optional subscription that unlocks additional features.

Prices are in US dollars and may differ in other regions because of local pricing tiers, taxes and currency conversion. The price displayed to you at the moment of purchase in the App Store is the authoritative price. Any "compare at" or "save" figure shown in the app is a comparison against paying monthly for the same period, for illustration only.

Auto-renewal (please read)

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Your subscription renews automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage the subscription and turn off auto-renew in iPhone Settings → your name → Subscriptions → Peak.
  • Cancelling stops future charges. It does not end the period you have already paid for — Elite stays active until that period expires.
  • Deleting the app does not cancel a subscription. You must cancel through the App Store.

Free trials and offers

Where a free trial or introductory offer is available, it is stated at the point of purchase. If you buy a subscription during a free trial, any unused portion of that trial is forfeited. Eligibility for offers is determined by Apple and may be limited to new subscribers.

Price changes

We may change subscription prices. Any change applies only to future billing periods, and Apple will notify you in advance and, where required, ask you to consent before a higher price is charged. If you do not agree, cancel before the next renewal.

7. Refunds

All purchases are processed by Apple, and refunds are at Apple's discretion under the Apple Media Services Terms. We cannot issue, reverse or expedite a refund for an App Store purchase.

To request one, go to reportaproblem.apple.com and sign in with the Apple ID used for the purchase. If you have a consumer right to a refund under the law where you live (for example the EU/UK statutory withdrawal right, or Australian Consumer Law), that right applies regardless of anything in this section — write to us and we will help you exercise it.

8. Coins, XP & virtual items

Peak includes virtual currency ("coins"), experience points, levels, streaks, avatar items and similar in-app elements. These:

  • have no monetary value, are not property, and cannot be redeemed for cash or transferred outside the Service;
  • are licensed to you, not sold, and may be adjusted, reset or removed if we discover a bug, an exploit or manipulation;
  • may be lost permanently if your account is terminated or deleted.

The current Peak build does not sell coins for real money. If that ever changes, the purchase terms in section 6 will apply and we will say so clearly at the point of sale.

9. Your content

Goals, tasks, journal entries, notes, messages to the coach, usernames and anything else you put into Peak are your content. You keep ownership of it.

You grant us a limited, worldwide, royalty-free licence to host, store, back up, transmit, display and process your content solely to operate and improve the Service for you — for example, syncing your tasks between your devices, or passing your message to the AI coach so it can answer. This licence exists for no other purpose, ends when you delete the content or your account, and does not permit us to sell your content or use it in advertising.

You are responsible for your content, and you confirm you have the right to submit it. Do not upload anything unlawful, infringing, or that you don't have permission to share.

10. Social features

Peak includes friends, nudges, groups, challenges and leaderboards. When you use them, information such as your username, avatar, streak length, level and challenge scores becomes visible to the people you have connected with. Your journal entries and coach conversations are never shared with other users.

Invitation links to challenges are unguessable but not secret — anyone holding a link can join that challenge. Only send them to people you intend to compete with.

Do not use social features to harass, bully, threaten, impersonate, spam or sexualise anyone. We may remove content, disable social features, or terminate accounts for this behaviour, and you can report a user by emailing support@peakapp.org.

11. AI features

Peak includes AI-assisted features, including the coach, voice transcription and AI-generated plans. Our AI Policy describes in detail what those features do, which provider processes the data, and what they are never used for. In summary:

  • AI output is generated, not verified. It can be inaccurate, incomplete or plainly wrong. Use judgement before acting on it.
  • AI features are not a professional of any kind — see section 12.
  • AI features may be rate-limited, changed or withdrawn, and depend on a third-party provider whose availability we do not control.
  • You must not use them to generate unlawful, harmful, hateful or deceptive content, or to attempt to extract the underlying model or prompts.

12. Not medical advice

Peak does not provide medical, mental-health, psychological, legal or financial advice, diagnosis or treatment. Nothing in the app — including anything the AI coach says — is a substitute for a qualified professional. Never disregard professional advice or delay seeking it because of something you read in Peak.

If you are in crisis or think you may harm yourself or someone else, contact your local emergency number immediately. In the United States you can call or text 988 (Suicide & Crisis Lifeline). Outside the US, findahelpline.com lists local services.

Peak's optional Health integration reads data you explicitly authorise through Apple Health so that certain activities can be marked complete. It is a convenience feature, not a medical device, and must not be used to make health decisions.

13. Acceptable use

You agree not to: break any law; access another user's account; probe, scan or test the security of the Service; circumvent rate limits, paywalls, entitlement checks or usage caps; use bots, scrapers or automation against the Service; reverse-engineer the app or its network protocol except where law permits; interfere with the Service's operation; resell or commercially exploit any part of it; or use the Service to develop a competing product.

We may investigate suspected breaches and take any action we reasonably believe is appropriate, including removing content, restricting features, and suspending or terminating accounts.

14. Changes to the service

Peak is under active development. We may add, change, suspend or remove features, including features you value. Where a change materially reduces functionality you are paying for, we will give reasonable notice through the app or by email, and you may cancel your subscription as described in section 6.

We do not guarantee uninterrupted availability. The Service depends on third parties (Apple, our hosting and AI providers) and on your device and network.

15. Third-party services

The Service integrates third-party providers, including Apple (distribution and payments), Supabase (authentication, database and serverless functions), RevenueCat (subscription status), OpenAI (AI features), PostHog (product analytics) and Sentry (crash reporting). Their handling of data is described in our Privacy Policy. Links to third-party sites are provided for convenience; we do not control or endorse them.

16. Intellectual property

The Service — including its software, design, artwork, character assets, animations, copy, the Peak name and logo, and all related intellectual property — is owned by us or our licensors and is protected by copyright, trademark and other laws. Except for the licence in section 5, no rights are granted to you.

If you send us feedback, ideas or feature suggestions, you grant us an unrestricted, perpetual, royalty-free right to use them without obligation or compensation to you. We know that is a broad clause; it exists so that a suggestion in a support email can be built without a legal negotiation.

17. Termination

You may stop using Peak at any time and delete your account from inside the app (see Delete your account). We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the Service.

If we terminate your account without cause and you have paid for an unused subscription period, we will ask Apple to refund the unused portion or provide equivalent value. Sections that by their nature should survive termination — including sections 8, 9, 16 and 18 to 22 — survive it.

18. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy or non-infringement.

We do not warrant that the Service will be uninterrupted, secure or error-free, that AI output will be accurate, or that using Peak will produce any particular result. We make no promise about the outcomes you will achieve. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

19. Limitation of liability

To the maximum extent permitted by law, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or anticipated savings, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) fifty US dollars ($50).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. If you are a consumer in the EEA, UK or another jurisdiction with mandatory consumer protections, those protections apply in addition to these Terms.

20. Indemnity

You agree to indemnify and hold harmless Peak and its owner from any claim, demand, loss or expense (including reasonable legal fees) arising from your content, your use of the Service in breach of these Terms, or your violation of any law or third-party right. This does not apply to claims caused by our own breach or negligence.

21. Governing law & disputes

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws rules, and excluding the UN Convention on Contracts for the International Sale of Goods.

Talk to us first

Before filing any formal claim, you agree to contact us at support@peakapp.org with a description of the dispute and to give us 30 days to resolve it informally. Most problems are a bug or a billing error and are fixed in a day.

Venue

If a dispute cannot be resolved informally, you and we agree to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada, and to venue in those courts.

If you are a consumer resident in the EEA or the United Kingdom, nothing in this section deprives you of the protection of the mandatory laws of your country of residence, or of your right to bring proceedings in your local courts. EU residents may also use the European Commission's online dispute resolution platform.

22. Apple-required terms

The following apply because Peak is distributed through the Apple App Store, and are required by Apple:

  • These Terms are between you and us only, not with Apple. Apple is not responsible for the app or its content.
  • Your licence to use Peak is limited to Apple-branded devices you own or control, as permitted by the App Store Terms of Service, including the Usage Rules.
  • Apple has no obligation to provide maintenance or support for Peak.
  • If Peak fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claim by you or a third party relating to Peak, including product liability, legal or regulatory non-compliance, and consumer protection or privacy claims.
  • Apple is not responsible for investigating, defending, settling or discharging any third-party claim that Peak infringes intellectual property rights.
  • You represent that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting," and are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

23. Changes to these terms

We may update these Terms. When we do, we will change the "Last updated" date at the top of this page, and for material changes we will give notice in the app or by email before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms. If you don't accept them, stop using the Service and cancel any subscription.
